1. Scope of Application
These General Terms and Conditions, hereinafter referred to as the GTC, apply to all orders, deliveries, and services processed through the online shop of NIZE-PERFUMES GmbH.
By accessing this website, using the online shop, and placing an order, the customer agrees to these GTC.
Deviating terms from the customer will only be recognized if NIZE-PERFUMES GmbH has explicitly agreed to them in writing.

3. Offer and Products
The presentation of products in the online shop serves as non-binding information and does not constitute a legally binding offer.
NIZE-PERFUMES GmbH strives to keep all information regarding products, prices, availability, images, and descriptions accurate and up-to-date. Changes, errors, prior sales, and technical adjustments are reserved at all times.
Product images on the website may slightly differ in color, design, or packaging from the actual product delivered.
4. Conclusion of Contract
By submitting the order, the customer makes a binding offer to conclude a purchase contract.
Receipt of the order is typically confirmed automatically via email. This confirmation does not yet constitute acceptance of the offer.
A contract is only concluded once NIZE-PERFUMES GmbH explicitly confirms the order or dispatches the goods to the customer.
NIZE-PERFUMES GmbH reserves the right to reject orders without stating reasons, particularly in cases of unavailability, obvious pricing errors, or justified doubts regarding the accuracy of the customer’s information.
5. Prices
All prices are stated in Swiss Francs (CHF).
Additional costs, particularly shipping, packaging, or any applicable surcharges, will be displayed separately during the ordering process.
The prices published on the website at the time of ordering shall apply.
6. Payment Terms
Payment is made exclusively through the payment methods offered in the online shop.
NIZE-PERFUMES GmbH reserves the right not to offer certain payment methods in individual cases or to allow them only under specific conditions.
In the event of late payment, NIZE-PERFUMES GmbH is entitled to withhold further deliveries or withdraw from the contract.
7. Delivery and Shipping
Delivery is made to the shipping address specified by the customer within Switzerland and to those countries offered during the ordering process.
The stated delivery times serve as estimates and are non-binding, unless expressly agreed otherwise in writing.
Delays due to force majeure, supply shortages, transport issues, or official measures do not give rise to claims for damages.
Once the goods have been handed over to the shipping carrier, the risk passes to the customer to the extent legally permissible.
8. Retention of Title
Until full payment of all claims arising from the purchase contract, the delivered goods remain the property of NIZE-PERFUMES GmbH.
9. Inspection Obligation and Notification of Defects
The customer is obligated to inspect the delivered goods immediately upon receipt and report any obvious defects, incorrect deliveries, or transport damage promptly, and in any case within 14 calendar days of receipt, in writing.
Failure to report within this period will result in the delivery being deemed approved, to the extent legally permissible.
10. Returns and Refunds
A statutory right of withdrawal generally does not exist under Swiss law.
NIZE-PERFUMES GmbH may voluntarily allow returns. A return will only be accepted after prior approval and only if the goods are unused, unopened, in original packaging, and in perfect condition.
For health and hygiene reasons, opened or used perfumes, cosmetics, or similar items are excluded from returns and exchanges.
The customer bears the costs and risk of return shipping, unless the return is due to a verifiable error caused by NIZE-PERFUMES GmbH.
Refunds are processed exclusively after inspection and approval of the returned goods.
11. Warranty
The statutory warranty provisions of Swiss law apply, unless otherwise regulated in these GTC.
In the event of valid defects, NIZE-PERFUMES GmbH will decide at its discretion whether to provide replacement goods, repair, credit, or refund the purchase price.
Any further claims by the customer are excluded to the extent legally permissible.
12. Liability
NIZE-PERFUMES GmbH is liable exclusively for damages resulting from intentional or grossly negligent conduct.
Any liability for slight negligence, indirect damages, consequential damages, loss of profit, data loss, or damages arising from delivery delays is excluded to the extent legally permissible.
Liability for vicarious agents is expressly excluded to the extent legally permissible.
13. Vouchers and Promotional Offers
Vouchers, discount codes, and special promotions are only redeemable within the specified period and according to the communicated terms.
Cash redemption, retroactive application to already completed orders, or the combination of multiple promotions is excluded unless otherwise stated.
14. Data Protection
The processing of personal data is carried out in compliance with the applicable data protection regulations of Switzerland.

15. Intellectual Property
All content on this website, in particular texts, images, logos, product names, designs, layouts, and trademarks, are legally protected.
Any use, reproduction, distribution, or modification without prior written consent from NIZE-PERFUMES GmbH is prohibited.
16. Applicable Law and Jurisdiction
Exclusively substantive Swiss law applies, excluding conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is, to the extent legally permissible, the registered office of NIZE-PERFUMES GmbH.
17. Final Provisions
Should individual provisions of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
In place of the invalid provision, the legally permissible regulation that most closely approximates the economic purpose of the invalid provision shall apply.
